These Terms of Service apply to all sales, quotations, deliveries, and use of products supplied by Ergolyx AB, whether made through direct contact, written quotation, invoice, or through our website, including purchases made through our Shopify-powered online store.

By placing an order or entering into a contract with Ergolyx AB, you agree to these Terms.

Scope and Applicability

These Terms apply to both business customers and consumers.

Certain provisions apply only to business customers or only to consumers, as stated in these Terms.

Where mandatory consumer protection laws apply, those rights are not affected by these Terms.

Contract Formation

For business customers, a binding contract is formed when a written quotation issued by Ergolyx AB is accepted, when a written agreement is signed by both parties, or when an invoice is issued and paid.

For consumer customers, a binding contract is formed when an order placed through the website is confirmed by Ergolyx AB, including through automated order confirmation from the online store.

Ergolyx AB may refuse or cancel an order where required due to product unavailability, incorrect pricing, suspected fraud, payment issues, or legal or regulatory restrictions.

Prices and Payment

Prices are stated in the currency shown at checkout, on the quotation, or on the invoice.

For business customers, prices are exclusive of VAT unless explicitly stated otherwise.

For consumers, prices include VAT where applicable.

Delivery costs, customs duties, import charges, and applicable taxes are shown at checkout or confirmed in writing before the order is finalized, unless they are already included in the agreed price.

Payment terms are specified at checkout, on the quotation, invoice, or order confirmation.

Ergolyx AB reserves the right to require full or partial advance payment.

Products and Product Information

Ergolyx AB sells ergonomic office furniture, including desks, chairs, and related products.

Product images, descriptions, measurements, colors, and specifications are provided for information purposes. Minor variations in materials, finishes, colors, or appearance may occur and are not considered defects unless they materially affect the product’s function or agreed specification.

Delivery

Ergolyx AB delivers products to the address specified by the customer.

Delivery options, delivery costs, and estimated delivery times are shown at checkout or confirmed in writing before the order is finalized.

Delivery times are estimates unless explicitly agreed as binding in writing.

For business customers, the risk of loss or damage passes upon delivery to the agreed address, unless otherwise agreed in writing.

For consumers, the risk passes when the goods have been physically received by the consumer or by a person chosen by the consumer to receive the goods.

Inspection and Acceptance

Customers should inspect products promptly upon receipt.

Business customers must report visible defects, damage, or discrepancies without undue delay after delivery.

Consumers must report defects within the time limits provided by applicable consumer protection law.

Returns and Withdrawal

For business customers, no right of return or cancellation applies unless expressly agreed in writing or required under applicable warranty terms.

For consumers, a statutory right of withdrawal applies where required by applicable consumer protection law.

The withdrawal period is fourteen days from the date the consumer receives the goods.

To exercise the right of withdrawal, the consumer must contact Ergolyx AB at support@ergolyx.com before the withdrawal period expires.

Products should be returned unused and handled only to the extent necessary to assess their nature, characteristics, and function.

Products should be returned in their original packaging where reasonably possible.

Deductions for diminished value may be made where permitted by law if the product has been handled more than necessary.

Warranty

Ergolyx AB provides a limited product warranty covering defects in materials and workmanship arising during normal use.

This warranty applies to products used under normal conditions in professional office and home office environments.

The warranty applies only to the original purchaser unless otherwise agreed in writing.

The warranty period begins on the date of delivery to the original purchaser.

This warranty applies in addition to any mandatory statutory rights under applicable law and does not limit such rights.

Covered Components

For desks, the warranty covers the frame and structural components for a period of ten years.

The lift motor, control box, handset, and related electronics are covered for a period of five years.

For chairs, the warranty covers the frame, base, and casters for a period of ten years.

The mechanism, gas lift, and armrests are covered for a period of five years.

Warranty periods apply per component and not to the product as a whole.

Warranty Exclusions

This warranty does not apply to desktop surfaces, fabric, mesh, foam cushioning, or cosmetic changes.

It also excludes damage resulting from normal wear and tear, misuse, abuse, overloading, incorrect installation or assembly, unauthorized modification or repair, accidental damage, transport damage occurring after delivery, or environmental exposure.

Minor variations in materials, finishes, colors, or appearance that do not affect functionality are not considered defects.

Warranty Claims

To submit a warranty claim, the customer must contact Ergolyx AB at support@ergolyx.com.

The customer must provide proof of purchase, a description of the defect, and photographic or video documentation showing the issue.

Ergolyx AB may request additional information where necessary to assess the claim.

Warranty Remedies

If a defect is confirmed to be covered under this warranty, Ergolyx AB will determine whether to repair, replace, provide replacement parts, or otherwise resolve the claim.

This warranty does not entitle the customer to a full product replacement unless Ergolyx AB determines that repair or replacement of the defective component is not reasonable.

For consumers, mandatory statutory rights remain unaffected.

Limitation of Liability

To the maximum extent permitted by law, Ergolyx AB shall not be liable for indirect or consequential losses, including loss of profit, loss of business, downtime, or business interruption.

For business customers, Ergolyx AB’s liability is limited to the value of the product supplied.

These limitations do not apply where liability cannot be limited under mandatory law, including applicable consumer protection legislation.

Force Majeure

Ergolyx AB is not liable for failure or delay in performance caused by circumstances beyond its reasonable control.

This includes transport disruptions, supplier delays, labor disputes, natural disasters, governmental actions, customs delays, technical failures, or other events outside Ergolyx AB’s reasonable control.

Consumer Complaints

Consumers should contact Ergolyx AB at support@ergolyx.com if they have a complaint.

We aim to resolve complaints directly and fairly.

If a consumer dispute cannot be resolved directly, the consumer may contact the National Board for Consumer Disputes in Sweden, Allmänna reklamationsnämnden (ARN).

Governing Law and Jurisdiction

These Terms are governed by Swedish law.

For business customers, disputes arising out of or in connection with these Terms shall be settled by Swedish courts.

For consumers, mandatory consumer protection rights and mandatory jurisdiction rules under applicable law remain unaffected.

Changes to These Terms

Ergolyx AB may update these Terms from time to time.

Updated Terms apply from the date they are published. Existing contracts are not affected unless required by law or agreed in writing.
